VYRL – Terms of Service

1. Acceptance of Terms

Welcome to VYRL, a platform owned by VYRL LLC under R3vival Network LLC. By accessing or using our services (“the Platform”), you confirm that you are at least 13 years old and have the capacity to agree to these Terms of Service (“ToS”). If you do not agree, you may not use VYRL. We reserve the right to suspend or terminate any account that violates these Terms.

2. Account Registration & Access

• Accurate Information: You must provide accurate details, including your email and social media username(s).
• Whop Subscription: Access to VYRL is managed through Whop; canceling your Whop subscription terminates your VYRL account.
• No Sharing or Reselling: You cannot resell, share, or transfer your account to others.

3. User Responsibilities

You agree to:

• Upload only videos/content that you have the legal right to use.
• Refrain from impersonating others or accessing another user’s data.
• Use the platform solely for content creation and AI-based analysis.
• Observe all relevant laws, including Instagram’s terms and age limits (13+).
• Abide by any usage or rate limits we impose; we may throttle or block access for misuse, including bots or scraping.

Failure to comply may lead to immediate account suspension or termination.

4. Payments & Refunds

• Please note that any free trials, beta access, or promotional offers are at our discretion and may be subject to additional terms. We reserve the right to modify or terminate trial periods at any time.
• VYRL operates via paid subscriptions through Whop.
• Refunds are generally available if requested within 24 hours of purchase; after this window, refunds are case-by-case.
• No chargebacks after the 24-hour period—users must contact VYRL support for assistance.

5. Data Collection & Privacy

We collect various data including user information, social media usernames, video content and features, and AI interactions. We use third-party services such as Stripe for payment processing, Whop for subscription management, and XFlareHosting for hosting and security. We do not share user data without prior notification. 6. Content Ownership & AI Processing

• You own your uploaded videos.
• VYRL owns the extracted features, AI chat content, and any metadata derived from those videos.
• We may use anonymized or aggregated data for AI training, unless you opt out.
• With your explicit consent, we may showcase anonymized AI-generated success stories or examples featuring your content for marketing purposes.
• You may not reverse-engineer, decompile, or otherwise attempt to derive the source code, AI models, or underlying algorithms powering the Platform.
• We will not use your videos for marketing unless you grant explicit permission.

7. Termination & User Rights

• Account Termination: Canceling your Whop subscription terminates your VYRL account.
• Data Deletion: Users may request deletion of personal data, AI-generated feedback, and chat logs by contacting us at tristan@govyrl.tech.

8. AI Usage & Limitations

Our platform uses AI models to analyze videos and produce insights. AI output may contain inaccuracies; we do not guarantee specific results or social media performance outcomes. No user rights or account actions are impacted solely by automated AI decisions.

9. Disclaimers & Liability Limitations

• No Guarantee of Virality: VYRL provides content suggestions but does not assure engagement or success.
• As-Is Basis: The platform is provided “as is,” without warranties of any kind.
• No Liability for AI Errors: We are not responsible for harm or losses stemming from AI-generated advice.

10. Changes to These Terms

We may update these Terms at any time. When we make material changes, we will notify you by email or in-app notice and update the “Last Updated” date. Continued use of the Platform constitutes acceptance of the updated Terms.

11. Governing Law & Arbitration

These Terms shall be governed by the laws of the State of California, without regard to its conflicts of law principles, even though we are not yet registered there. Any disputes arising out of or relating to these Terms shall be resolved through binding arbitration in accordance with the rules of a nationally recognized arbitration service. You hereby waive any right to participate in a class action against VYRL LLC or R3vival Network LLC.
